1. Scope & Operator
These Terms govern your use of the Swiss Whale Intelligence service ("Service") operated by Catering & Event Services GmbH, Badenerstrasse 116, 8952 Schlieren, Zürich, Switzerland (UID CHE-115.101.107, commercial register CH-020.4.040.988-4; "we", "operator").
2. Nature of Service — Information, not Advice
The Service provides real-time on-chain Bitcoin intelligence (transaction alerts, volume-index scoring, exchange flow analysis, dashboard, API). It is an information service under Swiss law and does not constitute:
- Financial advice or investment recommendation under FIDLEG/FinSA
- Portfolio management or discretionary asset management
- A regulated service under FINMA oversight (BankG Art. 3, FinIG Art. 17 — outside scope)
- A trading venue, broker service, or custodian
Past performance of any strategy published on our Open Trading Ledger does not guarantee future results. All on-chain observations are descriptive, not prescriptive.
3. Age Restriction
Use of the Service is restricted to persons aged 18 years or older. By using the Service you confirm you are of legal age in your jurisdiction.

The Trial does not auto-convert into a paid subscription; after 30 days the trial expires unless you actively subscribe via Stripe checkout. Annual subscriptions may become available; if so, an approximately 17% discount will apply.
5. License — Personal vs Business Use
This section defines what you may and may not do with data and content obtained through the Service. It applies to all tiers; the License column in §4 indicates which row applies to you.

Attribution standard
When attribution is required, use one of:

Out-of-scope behaviours (any tier)
- Scraping the public dashboard or API to bypass rate limits
- Re-publishing the Open Trading Ledger CSV without the SHA256 verification metadata
- Misrepresenting your tier to obtain higher rate limits
- Sharing API keys across organisations
6. Multi-Seat Rules
The Pro tier includes 3 seats per account. Each seat:
- Is bound to a unique authenticated user (Telegram-ID, Google-OAuth, or Email)
- Counts toward the shared monthly API quota (100,000 calls)
- Inherits the Business license from the parent account
- May be reassigned to a different user once per 30-day period
Sharing a single seat across multiple humans (sharing credentials) violates these Terms and may result in service termination without refund. If your team needs >3 seats, contact us for an Enterprise plan at contact@swisswhaleintelligence.com.
7. Academic Tier Eligibility
The Academic tier is provided free of charge for legitimate academic and educational use. To qualify:
- Sign-up email must be on a verified academic domain:
.edu,.edu.*,.ac.*,.uni-*, or recognised Swiss / EU / US / UK / DE / FR / IT / ES / NL / BE / AT / NO / SE / DK / FI / PL / CZ / HU / IL university domains - Use must be for research, teaching, journalism, or course-related work — not commercial trading
- Renewable annually; we may request brief written confirmation of continued academic affiliation
- Citation in published work that uses our data is required (see §5 attribution standard)
Approval is automatic for matching domains. For unusual cases (independent researcher, non-affiliated journalist, etc.) email academic@swisswhaleintelligence.com.
8. Refund & Cancellation
You can cancel a paid subscription at any time via the Telegram Premium Bot or by emailing us. The following rules apply:
- The currently paid period is not refundable after the first 14 days have elapsed.
- Within the first 14 days of a new paid subscription, we offer a pro-rata refund for the remaining billing period upon written request.
- After cancellation, your access continues until the end of the current paid period; no further charges will be made.
- Plans may be up- or downgraded at any time; charges are pro-rata billed/credited.
- Trials never auto-convert. No charges occur unless you actively subscribe.
9. Right of Withdrawal (Widerrufsrecht)
As a Swiss information service for B2B and private subscribers, no mandatory EU-style 14-day right of withdrawal applies under Swiss Consumer law. However, the §8 first-14-days pro-rata refund satisfies the spirit of EU 2011/83 Art. 16(m) on a goodwill basis. Our 30-day free trial means you can fully evaluate the Service before any payment is made.
10. Fair-Use & Rate Limits
API subscribers may not exceed the documented rate limits:
- Free / Anonymous: 1,000 calls/day, 10/min
- Trial & Intelligence (paid): 10,000 calls/day, 30/min
- Pro: 100,000 calls/month, 60/min
- Academic: equivalent to Intelligence, 10,000 calls/day
- Enterprise: per agreement
Abuse — running public mirrors, selling derived data without written permission, sharing API keys across organisations, or systematic rate-limit circumvention — may result in service termination without refund.
11. Data Protection
Processing of personal data is governed by our Privacy Policy, which complies with Swiss revDSG (2023) and EU GDPR.
12. Limitation of Liability
We strive to provide accurate on-chain data, but we disclaim all liability for trading losses, missed signals, data inaccuracies, third-party service outages (Stripe, Telegram, Bitcoin Core, etc.), or downstream decisions made on the basis of published information. Maximum cumulative liability per user is capped at the fees paid by that user in the 12 months preceding the event giving rise to the claim.
13. Governing Law & Jurisdiction
These Terms are governed by Swiss law. Place of jurisdiction is Zürich, Switzerland. For consumers in Switzerland, mandatory consumer-protection provisions remain unaffected.
14. Changes to These Terms
We may update these Terms. Material changes will be notified via the dashboard 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
